Know your rights - Traffic Rules

I was travelling back from my mother’s home to my husband’s home; a police constable stopped me and asked to show the documents, and told I was over speeding while I was not. The fun part of this incident is there were a few college students from whom this cop was accepting money and letting them go off…



What triggered me to write this blog today on the eve of the new year is I again saw similar things happening again where there is no officer and only a few constables stopping students and checking…and my intention to write this article is to educate all those who are reading this blog on the law involved in collecting fine for violating the traffic rules in Karnataka…


1. No Policeman should stop you merely for checking the documents, if you have committed any visible violation of traffic rules… like not wearing a helmet, Over speeding, Rash driving, No number plate, disturbing the traffic etc… you can be stopped and in this process you can be asked to show the documents. (RC Book/Smart Card, DL, Emission Test and Insurance)

2. Only Asst. Sub-Inspector (one star), Police Sub-Inspector (two star) and Police Inspector (three star) are authorized to receive payments against violation and issue a receipt. No Police Constable or head constable can issue a receipt and therefore receive a payment. They can however record the violations on the basis of which violation ticket will follow. This ticket can be settled at any of the traffic police stations.

 3. If you are not carrying your wallet with you or you don’t have the money to pay the fine, you can surrender your DL if you are carrying with you to the officer in charge and collect the receipt and pay the fine in your jurisdictional police station and collect the DL Back. If and only if you are not carrying the DL with you the Cop can ask you to leave your vehicle.

So friends, if you have not violated any traffic rule, the Cop cannot ask you to stop only the reason of verifying the documents, if you face such a situation you have all rights to refuse the officer's request. If have been stopped without reason, you can note down the name and rank of the police officer and lodge a complaint on the website or email us at addlcptrafficbcp@gmail.com if you are in Bangalore, and if you are in Mysore you can reach out to the commissioners office and file a complaint.


You in your compliant need to mention certain details, such as the place, time and name of the officer concerned, to take action.


The key takeaways are ….


a. Don’t Bribe the Cop, if you have violated the traffic rules duly collect the challan and pay fine.

b. If he is Constable or Head constable and is not carrying a chalan book and asks you to pay fine, go ahead and ask him to give the receipt… he will not be able to give receipt because he is not authorized… educate him not to do so and file a complaint against such instances.

Ms. Sonia , I and my fiancee wish to get married in a temple in Bangalore with close relatives attending it, my question is are the photographs taken in the temple during wedding serve the purpose of being a proof of the wedding? if yes what are the requirements, like the priest should be visible doing the rites or the witnesses blessing the etc? has to be shown specifically? Please reply....i await your kind advice.

Yes the photographs taken during the wedding in the temple are good enough as proofs for being married. Typically the marriage registration will need a proof showing you and your wife exchanging garlands. Its good to have in background the temple / priest performing the rites.
